0. This software is licensed, not sold, from Eternity Software (www.eternitysoftware.com).
1. Eternity Software grants you one license to install and use this software as an individual on a single computer except where detailed in clause 2. If you do not agree to the following terms of this license, please un-install and remove all copies of the software from all media in your possession.
2. You may install and use the software on a second computer provided that you are not making use of the software on both computers at the same time and provided the computer is for your sole use or access to this software is limited to your individual use only. Additional licenses must be purchased if more than one person uses the software or your use of the software makes use of multiple copies of the software at the same time. You may make back-up copies of the software for archival purposes. You may permanently transfer your license to use the software to another party who will be bound by this agreement, provided you do not retain any copies of the software.
Therefore, you must treat this software just like a book. By saying "just like a book", Eternity Software means that this software may be used in any location by you, and may be freely moved from one computer or location to another, so long as there is no possibility of it being used on more than one computer at a time. Just as a book cannot be read by two different people in two different places at the same time, neither can the software be available for use by same person in two different places at the same time without express written permission from Eternity Software. Furthermore, unlike a book, the software cannot be loaned to another individual or organisation at any time. You are the holder of the sole license.
3. The software is protected by the copyright laws of the Australia, the U.S.A., and other countries. Eternity Software retains all intellectual property rights to the software as covered, but not limited to, said copyright laws. Eternity Software has sold a license to use a single copy of the software. Eternity Software has not granted any further rights to access, reverse engineer, decompile, or otherwise modify the software except where permissible by law or where written permission has been obtained from Eternity Software.
4. You may not separately publish, sell, market, distribute, lend, lease, rent, or sublicense this software. However, this license is not to be construed as prohibiting or limiting any fair use sanctioned by copyright law, such as permitted library and classroom usage or reverse engineering.
LIMITED WARRANTY
5. Eternity Software warrants that the software will provide the features and functions generally described in the product specification on our website when you purchased it and in the product documentation. Media on which the Software is furnished, if any, will be free from defects in materials and workmanship.
6. Eternity Software does not warrant that the software or your ability to use it will be uninterrupted or error-free. To the extent permitted by applicable law, we disclaim any implied warranty of merchantability or fitness for a particular purpose.
7. Eternity Software has taken all reasonable steps to keep the software free of viruses, spyware, "back door" entrances, or any other harmful code. Eternity Software will not track or collect any information about you, your data, or your use of the software except as you specifically authorise. We will not intentionally deprive you of your ability to use any features of the software or access your data except in terms of "Demonstration" or “Trial” software.
Demonstration or trial software may be limited in some fashion and after the lapse of the demonstration or trial conditions have been met, the software may be rendered less operable. It is always the intention of Eternity Software that there be a method to retrieve your data from the software after such a demonstration or trial period has expired.
LIMITATIONS ON LIABILITY
8. Your exclusive remedy under the above limited warranty shall be, at our option, either a full refund of the purchase price or correction of the defective software or media. To the fullest extent permitted by applicable law, Eternity Software disclaims all liability for indirect or consequential damages that arise under this license agreement. Nothing in this agreement limits our liability to you in the event of death or personal injury resulting from gross negligence, fraud, or knowing misrepresentation on our part.
GENERAL PROVISIONS
9. If any part of this agreement is found to be invalid or unenforceable, the remaining terms will stay in effect. This agreement does not prejudice the statutory rights of any party dealing as a consumer.
